Warranty
TWO-YEAR LIMITED WARRANTY ON BIRDS:
Parrot Country LLC ("Seller") offers the most extensive
warranty in the industry. All of its birds are guaranteed against pre-existing
conditions such as bacterial disorders, parasites, viruses or serious
deformities at the time of sale / shipping. Seller guarantees that its
birds are free of viral infections, pathogenic bacterial infections,
fungal infections and congenital defects. This guarantee shall continue
for a period of two years from the date of purchase. If one of its birds
becomes ill or expires during this two-year period and the illness or
congenital defect was present in its bird prior to its being sold, Seller
will replace the bird. Notification must be made within 24 hours of
onset of symptoms or the guarantee is void. A licensed avian veterinarian
must make the diagnosis of the purported pre-existing conditions. Parrot
Country LLC’s veterinarian must concur with the diagnosis and
all laboratory tests and results shall be made available to him/her.
This guarantee shall be void if the bird’s leg band is removed
or tampered with in any way.
NOTE: A growth of gram-negative bacteria, post-shipping shall not be deemed disease, but is rather a stress-related reaction to being shipped. Please feel free to call us about any questions you may have regarding its guarantee.
The health of its babies is of utmost importance to Seller. Seller does everything possible to provide them with the best nutrition and veterinary supervision available to ensure that you will receive the healthiest bird possible.
The TWO YEAR LIMITED WARRANTY is subject to the following
ongoing conditions:
Purchaser must follow Parrot Country LLC ’s nutritional
program specifically designed for Purchaser’s bird. (Call Parrot
Country LLC for details.)
Purchaser must retain all receipts for nutritional products purchased as outlined in the program.
In the event Purchaser fails to continue the nutritional program or to retain documentation of the purchase of the required products, the two-year limited warranty shall be null and void.
RELEASE AND INDEMNIFICATION BY PURCHASER
It is expressly understood and agreed to by the Purchaser and
Seller that the Seller shall not be responsible for the death or health
related problems of any birds sold prior to weaning.
Purchaser hereby agrees to indemnify and release the Seller from any losses, claims, suits, and damages, including, but not limited to, any health problems that may result after the transfer of the bird to the Purchaser, including the death of the bird, for all birds transferred to the Purchaser prior to weaning.
(For the purposes of this provision, "weaning" shall be defined as the point in the development of the bird in which it is capable of eating on its own without being fed by any third party.)
All warranty service shall require the issuance of a Returned Material Authorization (RMA) number from Seller before shipment to Seller. Any items sent to Seller without such RMA shall be returned immediately to Purchaser at Purchaser’s expense without consideration of the Purchaser's request. In the event Purchaser’s claim is substantiated by Seller’s examination, Seller shall, at the exclusive option of Seller replace the defective merchandise or credit an equitable portion of the purchase price against further purchases. This shall be the sole and exclusive remedy of Purchaser for defective goods or Orders.
Deposits
DEPOSITS
Seller shall require a deposit to accompany all orders. Deposits
are non-refundable, but may, at the discretion of the Seller, be applied
as a credit for the Purchaser for other items held in stock by Seller.
CANCELLATION
Purchaser understands that once an Order has been placed with Seller,
Seller shall take immediate steps to design, order, and or manufacture
the Products ordered. As a result, no Order may be cancelled by Purchaser
for any reason beyond three (3) days after the date of execution of
such Order.
Shipping
All shipping is FOB carrier.
The shipping charges indicated in the online ordering process are calculated
on domestic US rates. International orders are subject to additional
shipping charges and will be charged accordingly. By completing checkout
on Purchaser’s order, Purchaser confirms his/her/its approval
of such additional shipping charges, or he/she/it may call (1-845 290 6682)
for a more precise quote. Purchaser is responsible for any import or
Customs requirements and/or fees/duties etc., of the destination country
where applicable.
Shipping and handling charges are not refundable.
Online Security
Our online store is secured with a GoDaddy.com Web Server Certificate. Transactions on the site are protected with up to 256-bit Secure Sockets Layer encryption.

Other
CLAIMS REGARDING PRODUCTS AND ACCESSORIES
Claims for defects, damages, shortages or disputes regarding any Order
must be made in writing within a period of fifteen (15) days from delivery
to Purchaser. Failure to make such claim within the stated period shall
constitute irrevocable acceptance.
Any such claims, disputes, deductions or any other credits against Seller's invoice to Purchaser shall be made in writing and sent by registered mail-return receipt requested from Purchaser and received by Seller within fifteen (15) days of the date of the invoice or sales receipt. PURCHASER'S FAILURE TO TIMELY MAKE ANY SUCH CLAIM SHALL CONSTITUTE IRREVOCABLE ACCEPTANCE BY PURCHASER OF THE SHIPMENT AND\OR INVOICE AND A BINDING ADMISSION BY PURCHASER THAT THE SHIPMENT AND\OR INVOICE\ SALES RECEIPT FULLY COMPLIES WITH ALL SPECIFICATIONS, TERMS AND CONDITIONS OF THE ORDER.
Purchaser shall hold for examination by Seller any items in the Order claimed to be defective. Any damaged or defective merchandise must be returned to the manufacturer with all parts, warranty cards, and instructions. Before returning any merchandise, you must call Seller at 1-845-356-2156 to get a "Return Authorization Number" ("RMA"). Seller will provide you with a return address to which you may send returning merchandise. No returns that arrive C.O.D. will be accepted.
Parrot Country LLC MAKES NO WARRANTIES, EXPRESS OR IMPLIED. NO WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE IS MADE. .
IN NO EVENT SHALL SELLER BE LIABLE FOR INCIDENTAL AND/OR CONSEQUENTIAL
DAMAGES.
Purchaser agrees that no other remedy (including but not limited
to incidental or consequential damages for lost profits, lost sales,
injury to person or property, delays or lateness, additional labor or
construction costs, any other incidental or consequential loss) shall
be available to the Purchaser. In the event this provision is held to
be unenforceable, Seller and Purchaser agree that consequential and/or
incidental damages shall be limited to $100.00 (or the total value of
the Order, whichever is less) per Order from Seller to Purchaser. Seller
must receive any such claim of damages in writing within 15 days of
delivery to Purchaser.
LIMITATION OF ACTIONS
ANY ACTION AGAINST SELLER ARISING OUT OF THE SALE CONTEMPLATED
HEREIN SHALL BE BROUGHT WITHIN ONE YEAR OF DISCOVERY OF BREACH OR SHALL
BE FOREVER BARRED.
TYPOGRAPHICAL ERRORS
In the event a Product is listed at an incorrect price or with
incorrect information due to typographical error or error in pricing
or product information, Seller shall have the right to refuse or cancel
any orders placed for products listed at the incorrect price. Seller
shall have the right to refuse or cancel any such orders whether or
not the order has been confirmed and Purchaser’s credit card has
been charged. If Purchaser’s credit card has already been charged
for the purchase and Purchaser’s order is canceled, Seller shall
immediately issue a credit to Purchaser’s credit card account
in the amount of the charge.
ORDER ACCEPTANCE
Terms of payment shall be determined in its discretion and
as otherwise agreed to by Seller. Payment shall be made by a credit
card or some other pre-arranged method of payment acceptable to the
Seller. Purchaser’s receipt of an electronic or other form of
order confirmation does not signify its acceptance of Purchaser’s
order, nor does it constitute confirmation of the order or its offer
to sell. Seller reserves the right, without prior notification, to accept
or decline Purchaser’s order or limit the order quantity for any
reason. Where payment is made by credit card, such payment is subject
to the approval of the financial institution issuing the credit card
and Seller shall not be liable in any way if such financial institution
refuses to accept or honor the credit card for any reason. Seller may
require, at its option, that any order placed over a certain dollar
amounts receive its pre-approval. Seller also may require additional
verification or information before accepting any order.
SALES AND OTHER TAXES
Seller is obligated to withhold sales tax for delivery within
certain states and all such taxes shall be automatically charged and
withheld. Unless Purchaser provides Seller with a valid and correct
tax exemption certificate applicable to the product shipped to the designated
destination prior to its acceptance of the order, the Purchaser shall
be solely responsible for sales and all other taxes associated with
the order not collected by Seller.
PRODUCT AVAILABILITY
Although availability may be indicated on the Site, Seller
cannot guarantee product availability. Some Products may not be available
for immediate delivery. Seller reserves the right, without liability
or prior notice, to revise, discontinue, or cease to make available
any or all products or to cancel any order. If there is any revision,
discontinuance, or cessation, after due notice to Purchaser, Seller
may at its discretion, ship products that have substantially similar
functionality and specifications to the products ordered or cancel the
order.
As a material incentive for Seller to enter into this transaction, Purchaser, being fully apprised of the diverse state statutes regulating such contractual relations, hereby irrevocably consents to the exclusive jurisdiction of the courts of the State of New York, County of New York (regardless of the laws of any other jurisdiction the State of New York may otherwise apply upon application of its conflicts of laws principles) and, to the extent permitted by applicable law, of any federal courts located in the State of New York in connection with any action or proceeding arising out of or relating to this transaction. Purchaser hereby waives the defenses of forum non conveniens and improper venue.
This provision is a material element of this transaction.
BY ENTERING INTO THIS TRANSACTION WITH SELLER, PURCHASER HEREBY EXPRESSLY CONSENTS TO ALL OF THE FOREGOING TERMS AND CONDITIONS.
